Environmental liability insurance: The coverage gap boards may overlook

Friday October 23, 2026
What if an environmental claim started with something as routine as landscaping or pool maintenance?

Environmental claims do not always begin with an obvious environmental event. They can develop from everyday property operations, making these exposures easy to overlook when boards review their insurance programs.

Knowing where the community's coverage ends and where additional environmental liability insurance coverage is important part of managing risk.

What is environmental liability insurance?

environmental liability insuranceEnvironmental liability insurance is specialized coverage for certain environmental and pollution-related exposures that may not be fully covered by traditional property and general liability policies.

The costs associated with an environmental incident can extend beyond repairing physical damage. Depending on the circumstances and policy, an incident may involve environmental testing, cleanup, emergency response, third-party bodily injury or property damage claims, legal defense costs and contamination that extends beyond the property line.

Environmental liability coverage can address specific risks within a community's insurance program. Coverage varies by policy, so reviewing definitions, limits, exclusions and conditions is essential.

Consider this: If an environmental claim occurred at our property, which policy would respond?

The answer can depend on the cause of the incident, the contaminant involved, and whether the contamination remains on the property or travels elsewhere. Reviewing those scenarios with an insurance professional can help boards better understand how their existing coverage may respond before a loss occurs.

Why environmental liability insurance is easily overlooked

Residential communities face environmental risks in everyday settings.

Water intrusion can contribute to mold growth. Amenity chemicals, fuel systems, and renovation work can all create exposure. Cooling towers and other building water systems can also harbor Legionella, a serious risk where residents are older or have health vulnerabilities.

Some conditions develop gradually or remain unnoticed until cleanup or liability costs become significant. Others emerge during routine maintenance or renovation work.

What environmental claims can look like

The following claim scenarios from PHLY Environmental offer useful context for boards evaluating environmental liability coverage.

Fertilizer runoff: $55,000

A community applied fertilizer to common areas. The fertilizer washed into a pond on an adjacent property, resulting in restoration costs of $55,000.

Muriatic acid spill: $50,000

A concrete cleaning compound containing muriatic acid, being used on a pool deck, spilled at a residential complex. More than a dozen people were injured; the pool area closed, and cleanup, liability, and defense costs followed. The claim totaled $50,000.

Mold exposure: more than $1.25 million

A resident alleged that mold exposure caused headaches, difficulty concentrating, and breathing problems. Defense costs exceeded $1 million, while the settlement exceeded $250,000.

These examples illustrate how environmental claims can arise from very different circumstances and how costs may involve more than remediation alone. Depending on the incident, expenses can include cleanup, bodily injury claims, property damage, and legal defense.

Where property and general liability coverage may stop

Environmental exclusions are an important part of the coverage conversation, as they can determine where standard coverage ends and environmental exposures may begin.

A property policy, for example, may respond to certain physical damage from a covered water loss while limiting or excluding costs associated with mold remediation. Environmental cleanup, emergency response, or third-party claims may also be subject to exclusions or separate coverage terms.

Having insurance for the underlying property does not necessarily mean every consequence of an incident will be covered by the same policy. For boards, understanding how existing policies work together can help clarify whether environmental exposures are adequately addressed or may require additional coverage.

Consider your property's specific environmental exposures

Every property has a different environmental risk profile. Building age, amenities, equipment, prior losses and upcoming projects can help boards determine which exposures deserve closer attention.

Boards can start by considering relevant property conditions, including:
  • Prior water intrusion or mold remediation

  • Pools, spas, cooling towers, and other water systems

  • Generators, fuel storage and chemicals stored on-site

  • Older building materials

  • Planned renovations or capital projects

  • Previous environmental incidents or remediation
Conditions known before a policy begins must be disclosed on the application and may be excluded from new coverage, so raising them early helps set realistic expectations.

Some exposures can also be reduced through proactive risk management. For example, plumbing failures can introduce moisture that contributes to mold growth. Water detection solutions can identify leaks earlier and support a faster response through real-time alerts and optional water shutoff capabilities, helping limit the extent of water damage.

What should boards ask about environmental insurance coverage?

Board members do not need to become insurance experts, but they should have enough information to recognize where meaningful gaps could exist.

When discussing coverage options, consider asking:
  • What environmental or pollution exclusions are included in our property and general liability policies?

  • How would our policies respond to mold, bacteria, or contamination?

  • What happens if contamination travels beyond our property?

  • Would testing, cleanup, third-party claims and legal defense be covered?

  • Could planned renovations or maintenance create additional environmental exposures?

  • How would defense costs affect the available environmental liability policy limit?
It can also be helpful to revisit environmental exposures when property conditions change. A major renovation, equipment upgrade, new amenity or prior incident may create different considerations than those that existed during an earlier insurance review.
